Many states have increased the level of scrutiny of health and safety issues related to the use of lasers and intense pulsed light devices for cosmetic treatments. New statutes and regulations have been proposed and task forces to study these issues have been formed. California
The California Legislature is currently considering Assembly Bill 2398 concerning ownership and operation of medical spas. The Medical Practice Act restricts the employment of physicians by a corporation or other artificial legal entity. Physicians must either own the practice, or must be employed or contracted by a physician-owned practice or medical corporation. The bill would authorize the revocation of a physician license when s/he knowingly practices medicine with or is employed as the medical director of a business organization that provides outpatient elective cosmetic medical procedures (such as a medispa). In addition, the business organization in violation of the Medical Practice Act will be guilty of a violation of the Penal Code.

On May 22, 2008 the bill was referred to the Senate Committee on Business, Professions and Economic Development. A hearing is scheduled for June 9, 2008.
